During a meeting with representatives of major associations of manufacturers and importers of goods and packaging, held in the Russian Ministry of Natural Resources on August 24, 2017, Sergei Donskoy, the head of the Ministry of Natural Resources of Russia, discussed the administration of new provisions of the law “On Production and Consumption Waste” related to the extended producer responsibility.

In particular, the representatives of the Ministry of Natural Resources of Russia informed about the progress of the preparation of regulatory and legal acts aimed at improving regulation. These include the draft amendments to the law “On production and consumption waste”. The draft law defines the conditions that ensure the participation of producers and importers in organizing activities for separate accumulation of waste for their further utilization. The document establishes the possibility of unlicensed collection of waste by trade and service enterprises for the purpose of further utilization.

The developed draft documents establish that the issued volumes of goods (packaging) should be understood as the volumes realized in the reporting period for domestic consumption in the territory of the Russian Federation. It also stipulates the definition of importers as the first buyers (recipients) of goods when they are imported from the territory of the member-states of the Eurasian Economic Union.

In addition, the regulation of the reporting system of producers and importers is being improved. So, according to the results of law administration practice provisions for reporting on the compliance with the standards of waste recycling of consumed goods and the declaration on the number of finished goods issued in circulation in the territory of Russia are detailed with regard to goods’ packaging. The amendments are aimed at excluding possible cases of declaration duplications in relation to the same goods and packaging, for clarifying the list of documents that are the basis for declaring by the importers of goods and packaging, subject to recycling. As a result, it shall simplify for companies the procedures for declaring issued goods and packaging and filling-out a reporting form on the implementation of waste management standards. It is also planned to regulate the form of the waste disposal certificate, which previously was only advisory in nature.

In accordance with the instruction of the President of the Russian Federation, Ministry of Natural Resources of Russia is preparing draft amendments to the regulatory legal acts providing for the expansion of the list of goods subject to recycling after the loss of their consumer properties and the increase in waste disposal standards. In particular, it is proposed to complement the list of recyclable goods with groups of “finished metal products”, “primary cells and primary batteries” and a special section “Packaging of finished goods, subject to disposal after loss of consumer properties”. In these acts, it is provided for identification of package, including the material from which it was produced.

In addition, the Ministry of Natural Resources of Russia has developed draft amendments to the law “On production and consumption waste”. The draft law has specified the conditions that ensure the participation of producers and importers in organizing activities for separate waste accumulation for their further utilization. Also, the draft bill clarifies the term “waste collection” – reception of waste from legal entities and individual entrepreneurs for further processing, recycling, neutralization, and disposal of such waste.

During the meeting representatives of the Federal Service for Supervision of Nature Resources (Rosprirodnadzor) noted that the requirement to indicate the availability of a license for the technology of waste processing in recycling certificate is only applicable to new equipment and technology.
